Questions SMEs ask
Does the EU AI Act apply to small companies?
Yes. The AI Act applies by what your AI does, not by company size. If you build, use or resell an AI system that reaches people in the EU, it applies to you, wherever you are based. Smaller companies do get some relief: fines are capped at the lower of the fixed amount and the percentage of turnover (Article 99(6)), the Commission will provide a simplified form of technical documentation for SMEs (Article 11(1)), and SMEs get priority access to regulatory sandboxes (Article 62).
How much does EU AI Act compliance cost for a small company?
It depends on your risk tier. If your systems are minimal risk, the work is a documented classification and AI literacy for your staff. With ActScope that starts free. If you run chatbots or publish AI-generated content, Article 50 disclosures apply now, covered by Starter at €39 a month. If any system is high-risk under Annex III, you need the full documentation set: Pro covers every document type for unlimited systems at €99 per seat a month. A consultant engagement for the same work commonly runs to tens of thousands of euros.
Do I need a consultant or a lawyer?
Not to get started. ActScope classifies your systems and writes first drafts of every document from what you tell it, with the relevant articles built in. For a high-risk system, have a lawyer or compliance adviser review the documents before you rely on them. You can send them for sign-off from inside ActScope.
How long does it take?
Classifying a system takes about five minutes. A document is generated in a few minutes once the system details are filled in. Most small teams can have their inventory classified and their Article 50 obligations closed within a day, and work through high-risk documentation over a few weeks rather than months.
We only use third-party AI tools such as ChatGPT or a vendor's chatbot. Does this apply to us?
Yes, as a deployer. You need AI literacy for the staff who use AI (Article 4, in force since February 2025), you must tell people when they talk to a chatbot or see AI-generated content you publish (Article 50), and if a tool is high-risk, for example AI used to screen job applicants, deployer duties under Article 26 apply from 2 December 2027. ActScope detects your role and only lists the duties that are yours.
